Under federal regulation (12 C.F.R. Section 1024.41), a lender can’t begin foreclosure proceedings until a borrower is at least 120 days delinquent. This period exists to allow time for loss mitigation, the process by which lenders and borrowers explore alternatives such as repayment plans or loan modification. It’s also the window where homeowners have the most options.

Notice & Publication Requirements

Once the 120-day period has passed and the lender decides to proceed, Tennessee law (Tenn. Code Sections 35-5-101 through 35-5-103) requires the lender to publish a notice of the foreclosure sale in a local newspaper at least twice, with the first publication at least 20 days before the scheduled sale date. The lender must also post the notice online through a third-party internet posting company for at least 20 continuous days and must mail a copy of the notice to the borrower on or before the first publication date.

Once the 120-day waiting period is satisfied and the publication requirement is met, the entire nonjudicial process can move from first notice to sale in roughly a month. There’s no court involvement to slow things down. A judicial foreclosure, where the lender files a lawsuit and the court oversees the sale, is far less common but can arise in contested matters.

Tennessee homeowners have the right to receive written notice and the right to cure the default before the sale. Tennessee doesn’t provide a general statutory right to reinstate the loan by paying all overdue amounts before the sale; that right exists under state law only for high-cost home loans. Many standard deeds of trust do give borrowers a contractual reinstatement right, so reviewing your loan documents is important. Tennessee law also provides a right of redemption after a nonjudicial sale, though many mortgage contracts include a waiver of that right, making it critical to act before the sale rather than after.
