Causes of Motorcycle Accidents

Nashville Motorcycle Accident Lawyers Protecting
the Rights of Injured Motorcyclists in Middle Tennessee

Insurance companies and drivers who have had collisions with motorcyclists will often say that the injured motorcyclist is at least partially to blame for the accident, even when it's not true. Unfortunately, this is a strategy that works with jurors and works against victims who do not have an experienced attorney to protect their interests.

At The Law Offices of James Flexer, we protect the rights of injured motorcyclists and help them to obtain the compensation they deserve from negligent drivers. If you were injured due to someone else's negligence, our attorneys will work directly with you to pursue fair compensation.

Contact us today to set up a free consultation with a knowledgeable Tennessee bike accident lawyer. We have offices in Nashville, Murfreesboro and Columbia. You will pay us no fees unless our efforts are successful.

Establishing the Cause of the Accident

Although the police and the insurance company for the other driver will both investigate the accident separately, neither of those parties will necessarily be looking for evidence that can be used to help you recover damages. Our attorneys know how to investigate these accidents and are prepared to aggressively investigate your case.

Common causes of motorcycle accidents:

  • Drivers who fail to see a motorcycle and yield the right-of-way, typically when turning left across traffic, cause the majority of motorcycle-car collisions.
  • Cell phone use, texting and other distractions are a growing cause of all motor vehicle accidents, not just motorcycle accidents.
  • Potholes, debris and other road surface defects can cause motorcyclists to lose control of their vehicles and crash.
  • Motorcycle design defects and defective parts can also cause accidents.

Motorcycle Accidents and Comparative Fault

Tennessee is what attorneys call "a comparative fault state."

The basic rule is that an injured plaintiff cannot recover damages if he or she is found to be at least 50 percent at fault for an accident. If a plaintiff's fault is less than 50 percent, then the amount of money he or she is awarded will be reduced by whatever the plaintiff's percentage fault was. For example, if an injured plaintiff is awarded $1 million, but was also found to be 49 percent at fault for the accident, the award will be reduced to $510,000.

The sooner you consult an experienced personal injury lawyer after your accident, the greater your chances of getting the results you legally deserve. Don't hesitate to contact us to discuss your options.
