Obtaining Post-Divorce Modifications in Tennessee
The one constant in life is change. For people who have been divorced, new changes sometimes require changes in divorce orders related to custody, visitation and support. While post-divorce modifications are quite common in Tennessee, they are not always easy to obtain.
At the Law Offices of James A. Flexer, we help clients who need to modify their divorce orders and those who want to preserve the status quo. In both types of cases, we fight to fully protect our clients' rights and interests. Contact us today for a free consultation with a knowledgeable family law attorney. We have offices in Nashville, Murfreesboro and Columbia.
Requirements
In Tennessee, there are only certain types of spousal support that can be modified, even if you or your former spouse have experienced a substantial change in circumstances. For that reason, it is important to first look at the final order that granted spousal support to see what type it is and whether it's modifiable or not. If the original spousal support order is modifiable, you will need to show the court that there has been a substantial change in circumstances (yours or your ex's) justifying the change you're seeking.
If you are seeking to modify a child custody, visitation or child support order, you will have to prove to the court that there has been a material change of circumstances in the life of the child and that the requested change is in the child's best interests.
Post-Divorce Relocation: When Does a
Custodial Parent Need Permission to Move?
If a primary custodial parent wants to move out of Tennessee (even if it's only a few miles away) or more than 100 miles out of the jurisdiction of the court which granted the divorce, he or she must give official notice to the other parent within 60 days of the move. If the other parent wishes to oppose the move, he or she must file an objection with the court within 30 days.
Whether you are planning to move outside these limits or your former spouse has notified you that he or she intends to move outside these limits, it is absolutely critical that you talk to an attorney as soon as possible.
Our lawyers will work hard to protect your rights and achieve your goals. Don't hesitate to contact us to discuss any family law or divorce-related matter.
